About LILIVANT

LILIVANT Pty Ltd (ABN 53 690 012 652) operates as an online marketplace platform.

Many products available on LILIVANT are sold and fulfilled directly by independent brands and designers. This means that when you purchase through our platform, the relevant seller is responsible for the product, fulfilment, shipping, and customer support relating to that order.

LILIVANT curates and facilitates the marketplace experience but is not the direct seller of most products listed on the platform unless otherwise stated.

Eligibility

By using our website, you confirm that you are:

• at least 18 years old; or 
• using the platform with permission from a parent or guardian. 

You must not use LILIVANT if you have previously been suspended from the platform or if your use would breach any applicable law.

Accounts

To access certain features, you may be required to create an account.

You agree to:

• provide accurate and current information; 
• keep your login details secure;
• keep your account information updated; and
• notify us immediately of any unauthorised access to your account. 

We reserve the right to suspend or terminate accounts where we reasonably believe these Terms have been breached.

Orders & Payments

All prices displayed on the platform are shown in the relevant currency displayed at checkout and include GST where applicable unless otherwise stated.

Payments are securely processed through trusted third-party payment providers, including Stripe.

By placing an order, you agree to purchase the selected goods at the displayed price, including any applicable shipping costs, duties, taxes, or fees shown at checkout.

We reserve the right to:

• cancel orders; 
• limit quantities; 
• refuse transactions; or
• correct pricing or technical errors. 

If an order is cancelled after payment has been processed, the relevant amount will be refunded to your original payment method.

Shipping & Delivery

Orders may ship directly from individual designers, brands, or fulfilment partners located around the world.

As a result:

• items may arrive in multiple shipments;
• delivery times may vary between brands and destinations; and
• separate tracking links may be provided for different parcels. 

Estimated delivery timeframes are provided as a guide only and are not guaranteed.

Customers may be responsible for customs duties, import taxes, or local charges unless otherwise stated at checkout.

Returns & Refunds

Our Returns Policy forms part of these Terms & Conditions.

Return eligibility may vary depending on the item, seller, or product type. Certain products, including made-to-order, personalised, vintage, intimate, or final sale items, may not be eligible for return unless required by law.

Where goods are faulty, damaged, unsafe, or not as described, customers may be entitled to remedies under applicable consumer laws, including the Australian Consumer Law.

Made-to-Order, Vintage & Special Pieces

Some products available through LILIVANT may be:

• made-to-order;
• customised;
• handcrafted;
• vintage;
• pre-loved; or
• upcycled. 

These pieces may:

• require longer production or dispatch times; 
• include natural variations;
• show signs of age or wear where disclosed; or
• be subject to different return conditions. 

Sellers are responsible for accurately describing these items.

Authenticity

Sellers listing designer or branded products on LILIVANT warrant that their goods are authentic and genuine.

Counterfeit, replica, or imitation products are strictly prohibited.

LILIVANT reserves the right to remove listings or suspend sellers where authenticity concerns arise.

Reviews & User Content

Customers may have the opportunity to post reviews, comments, images, or other content on the platform.

By submitting content to LILIVANT, you confirm that:

• the content is accurate and lawful;
• you own or have permission to share it; and
• it does not infringe the rights of others. 

You also grant LILIVANT permission to use submitted content for editorial, marketing, promotional, and platform purposes.

We reserve the right to remove any content that we consider misleading, offensive, unlawful, or inconsistent with our platform values.

Acceptable Use

You agree not to:

• use the platform unlawfully or fraudulently;
• harass, abuse, or threaten others;
• upload harmful or malicious content;
• interfere with the operation of the platform;
• misuse customer or seller information; or
• attempt to bypass the platform or marketplace fees. 

Third-Party Services

LILIVANT may use or integrate third-party services including:

• payment providers;
• shipping and logistics partners;
• analytics providers;
• social media platforms; and
• verification services. 

Your use of those services may also be subject to separate third-party terms and privacy policies.

Limitation of Liability

To the maximum extent permitted by law:

•  LILIVANT is not responsible for the conduct, products, or services of independent sellers;
• we are not liable for indirect or consequential losses; and
• our liability is limited to the amount paid through the platform in the 3 months preceding the relevant claim. 

Nothing in these Terms excludes rights that cannot legally be excluded under applicable consumer laws.

Privacy

Your use of the platform is also governed by our Privacy Policy.

By using the platform, you consent to the collection, use, and disclosure of personal information as outlined in our Privacy Policy.

Suspension & Termination

We may suspend or terminate access to the platform where we reasonably believe:

• these Terms have been breached;
• continued access may create legal or operational risk; or
• a user’s conduct may harm LILIVANT or other users.
